North Carolina does not strictly adhere to the “one-bite rule,” under which the owner of a dog determined to be “dangerous” based on previous behavior can be held liable for injuries or losses due to a subsequent bite or attack. Instead, the state uses a mix of this rule and strict liability under certain conditions. If a dog has previously shown aggression or has bitten someone before, the owner can be held liable under the one-bite rule. However, for specific breeds or if the dog was running at large at night, strict liability may apply.
