What constitutes a DWI in North Carolina?

In North Carolina, a DWI (Driving While Impaired) is charged when a driver operates a vehicle under the influence of alcohol, drugs (prescription, over-the-counter, or illegal), or a combination thereof, in a way that impairs their faculties to drive. A blood alcohol concentration (BAC) of 0.08% or higher for drivers 21 and over, 0.04% for commercial drivers, and any alcohol concentration for drivers under 21 constitutes impairment.
